1. Introduction
These Terms and Conditions govern the use of Safe Exam Support (SES), including our website, hosted services, self-hosted software components, and related support offerings. By using SES, you agree to these terms.
2. Scope of Services
SES provides software and service components for secure digital exams, including exam session management, Safe Exam Browser integration, configuration delivery, monitoring, AI-assisted services, grading services, and related infrastructure.
Services may be offered as:
– self-hosted deployments operated by the customer
– cloud-hosted services operated by us
– implementation, support, and consulting services
3. Customer Responsibility
Customers are responsible for:
– ensuring lawful use of SES within their institution
– managing user accounts, institutional systems, and LMS integrations
– verifying that exam configurations and workflows meet their academic and legal requirements
– maintaining appropriate internal policies for students, teachers, and administrators
– securing their own infrastructure in self-hosted deployments
4. Acceptable Use
Customers and users may not use SES:
– for unlawful, fraudulent, or abusive purposes
– to interfere with the security, availability, or integrity of the platform
– to attempt unauthorized access to systems, sessions, or data
– to upload or distribute malicious code
– to use the services in a way that harms other customers or users
5. Availability and Support
We aim to provide stable and reliable services, but uninterrupted availability cannot be guaranteed unless explicitly agreed in a separate service agreement or SLA.
Support levels, response times, maintenance windows, and service scope may depend on the applicable contract or support plan.
6. Self-Hosted Services
For self-hosted deployments, the customer is responsible for installation, hosting environment, backups, access control, infrastructure security, and operational continuity unless otherwise agreed.
We may provide documentation, onboarding, updates, or support, but the customer remains responsible for production operations in self-hosted setups.
7. Cloud-Hosted Services
For cloud-hosted deployments, we are responsible for operating the SES environment as agreed with the customer. Cloud services are hosted through a European hosting provider unless otherwise agreed.
Customers remain responsible for their own connected systems, user management, and institutional processes.
8. Data Protection and Privacy
Our handling of data is described in the applicable privacy policy. SES is designed to minimize processing of personal data, and as a general rule we do not store student or teacher personal data on SES servers.
Customers remain responsible for the lawful processing of data in their LMS, identity systems, and educational workflows.
9. Intellectual Property
All intellectual property rights in SES, including software, branding, documentation, designs, and service materials, remain with us or our licensors, unless explicitly agreed otherwise in writing.
Safe Exam Browser and other third-party open-source components remain subject to their own respective licenses.
10. Open Source Acknowledgement
SES builds on and integrates with open-source technologies, including Safe Exam Browser. We respect and support the open-source ecosystem and expect customers to comply with the license terms of third-party components where applicable.
11. Fees and Payment
Where services are provided on a paid basis, pricing, invoicing, payment terms, and any applicable taxes are defined in the relevant quotation, agreement, or order form.
Late payment may result in suspension of services where legally permitted and contractually applicable.
12. Warranties and Disclaimers
SES is provided with reasonable care and professional diligence. However, unless expressly agreed otherwise, services and software are provided on an “as available” basis.
We do not warrant that services will be uninterrupted, error-free, or suitable for every institutional, legal, or technical scenario.
13. Limitation of Liability
To the extent permitted by law, our liability is limited to direct damages arising from proven breach of contract or unlawful act. We are not liable for indirect or consequential damages, including loss of profits, loss of data, business interruption, or reputational harm.
Any further limitation of liability may be defined in a separate agreement.
14. Indemnity
Customers agree to indemnify and hold us harmless from third-party claims arising from misuse of SES, unlawful customer configurations, violation of law, or breach of these terms.
15. Suspension and Termination
We may suspend or terminate access to SES where necessary to protect the platform, comply with legal obligations, address security risks, or respond to material breach of these terms.
Customers may terminate use of SES in accordance with the applicable contract terms.
16. Changes to the Services
We may modify, improve, or update SES from time to time to maintain security, compliance, performance, or product quality. Material changes affecting contracted services will be communicated where appropriate.
17. Governing Law
These Terms and Conditions are governed by the laws of [Country], unless otherwise agreed in writing.
